“No Comment” On Impeachment Charges

In two consecutive commentaries, J.F. Kelly Jr. has lamented the Senate impeachment trial of Donald Trump. But remarkably, in neither of these two lengthy columns does Mr. Kelly state the actual articles of impeachment.

The President withheld public funds from Ukraine in order to create an investigation by a foreign government of his likely political opponent in our next elections. He then refused to provide Congress with any testimony or documents from the Executive Branch during the impeachment inquiry. Judge Andrew Napolitano, Senior Judicial Analyst for the Fox News Channel, believes that President Trump should be removed from office, stating, “What is required for removal of the president? A demonstration of presidential commission of high crimes and misdemeanors, of which in Trump’s case the evidence is ample and uncontradicted.”

President Trump declined to have his lawyers participate in the House impeachment inquiry, and his lawyers have presented no evidence in his defense during the Senate trial. Instead, they have argued that if the President thinks his re-election is in the public interest, then he is free to take any actions to support his re-election. This argument suggests that the President could arrest and jail his political opponents because he believes such action would be in the public interest. This is done on a regular basis in Russia. Is this what we want for the United States of America?
